*Condition / Inspection. Property is sold AS IS, WHERE IS, with all faults, and without warranties. Inspection is by appointment with the contact in the listing.
*Payment & Processor. All payments are handled by PayMac, Inc. through Public Surplus. Credit card (subject to Public Surplus' current $4,000 per transaction limit) or wire transfer only; no cash/checks/money orders. Payment is due within five (5) business days of the Notice of Award and is not deemed received until cleared by the Processor. A 10.5% Buyer's Premium applies.
*Removal. Buyer must remove items within ten (10) business days after the Notice of Award during posted business hours and by appointment. Buyer is responsible for all loading/rigging/transport and any damage to City property during removal. No on site repairs.
*Release. Release occurs only after cleared funds and presentation of the Notice of Award, Paid Receipt, and ID. Third party pickups require written authorization and ID. The City will update Public Surplus after pickup.
*Public Records. Transaction communications may constitute public records under Ch. 119, F.S., subject to any applicable exemptions.
*Sovereign Immunity. Nothing herein waives the City's protections under § 768.28, F.S.
